Tasc is still allowed to exist because they are not doing anything illegal. Sure I think a strong case can be made for false and deceptive advertising practices. However whether or not they actually help consumers is subjective to the person doing the analysis. Sure they do some things, that can make their member companies better than some of the worse offenders. Yes you are correct.
